Oakland To Enact Tenant Move Out Agreement Ordinance At City Council 3-20 Meeting

This was posted by Oakland Councilmember Lynette Gibson McElhaney in her newsletter as an item to pay attention to at the Tuesday March 20th City Council Meeting. It’s an ordinance that was introduced by CM’s Dan Kalb and Rebecca Kaplan to regulate move-out agreements between landlords and tenants is regulated under Oakland’s Just Cause for Eviction Ordinance. The Ordinance proposes to:

a) Require Property Owners to notify Tenants of their rights (in their language of choice) and provide tenants a 30 day period to consult with an Attorney to decide whether to cancel the agreement (if the unit has not been moved into yet)

b) Requires Property Owners to file an “Intent to Enter Into Move-Out negotiations” with the City of Oakland;

c) Enact penalties on landlords that repeatedly fail to comply.

Once adopted, the Ordinance will become effective on or after May 1st once the forms and instructions are made available to the public. via IFTTT
